By commissioning me, you are stating that you have read and agreed to these terms.

GENERAL TERMS

  • Prices are subject to change based on demand.

  • Commissions are first come first serve.

​

  • I have the right to reject any order for any reason.

​

  • Ill and rude behavior will not be tolerated. If it occurs, your commission will be canceled.

PAYMENT

  • All commissions must be payed 100% upfront. 

​

  • Accepted currencies are either Swiss Francs (CHF), Euros (€) or USD ($). 

​

  • I only accept payment through PayPal.

​

  • Do not pay before I have requested payment and have agreed to give you a slot.

PROCESS & REVISION

  • I try my best to make my customers happy. But in order to work well I require a good description of what you want and at least one clear reference of each character and object. 

​

  • The time for your commission to be completed can be anywhere between a couple of days to 3 months. This can depend on many factors such as health, type of commission, complexity and work/school. You will be notified as soon as possible if something comes up.

​

  • I will share progress photos with you and ask you if you accept my work so far. You will get 3 rounds of changes for your commission for free. Any more changes will have to be backed up with a fee. The amount of extra charge depends on the change you want me to make and is usually based on an hourly wage.

​

  • Any major changes after sketch approval and which require me to redo entire elements - such as changing the pose/shape of a character drastically, adding/removing entire outfits, redrawing parts of the image, etc. - will be charged additionally.

​

  • A fee will be added if you want something changed on the final piece (Unless it was a misunderstanding on my side). Small changes such small coloring/marking mistakes will be free of charge.

​

  • Once the piece is finished you will receive the full-resolution image. This is best given over E-mail or Telegram. Note that there is no physical product in the end. All of my work is done digitally.

COPYRIGHT & USAGE

I, Apex, the artist:

​

  • Will retain all copyrights over the commissioned artwork.

​

  • This means I will have the right to use the commissioned artwork to promote myself, use it as a commission example, use it in my portfolio, post it anywhere on any site as well as use it in any publications such as art books. 

​

  • I will not claim the intellectual property (the character/-s and object/-s) of a commissioned piece.

​

  • I will not profit further from the commissioned artwork unless you, the customer, break any of the terms.

​

​

You, the customer/commissioner:

​

  • Are allowed to post the artwork on any website and social media as long as you credit me for the art. You may use it as your icon and banner and for private use. 

​

  • You can print the art and claim the rights to your characters but not the artwork itself.

​

  • You may use the artwork to promote yourself as long as you give proper credit to me, the artist.

​

  • You retain the rights to the intellectual property.​

​

  • You may not use the artwork for commercial use or profit from it in any way. This includes things like reselling, redistributing, uploading to POD-services, selling prints, creating NFTs, etc.

The following is considered copyright infringement:

​

  • Reproducing/using the copyrighted artwork commercially - which means making money off of it in any way

​

  • Claiming the artwork/characters I designed as your own

​

  • Altering or changing the artwork without my consent

​

  • Removing any watermarks/signatures

REFUNDS & CANCEL-LATION

  • I have the right to cancel and refund the money for your commission at any time.​

​

  • If I am unable to start your commission you will receive a full refund.

​

  • If you cancel your order before I started it, you will receive a full refund.​

​

  • If you want to cancel your order after I've started it, you'll only get a partial refund based on the amount of work I have already completed.

​

  • If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to you myself.

​

  • If you do request a PayPal chargeback at any point of time when you were not allowed to ask for a refund, you will lose all beforementioned rights to the commissioned piece and I will have all the rights to further profit from the artwork. I will decline the chargeback and send PayPal our conversations in which we talked about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me ever again.

ALLOWED & DISALLOWED CONTENT

I will do:

  • Any kind of animals

  • Creatures/monsters/aliens

  • âš  Humans/humanoids 

  • ​⚠ Mecha

  • âš  Vehicles 

  • Blood/gore

  • Reference sheets

I will not do:

  • NSFW and any type of sexual content

  • Fetish art

  • Any sort of hateful and illegal content 

  • Overly complex characters, objects or backgrounds (e.g. urban settings)

  • Cutesy/"child-like" characters (I'm not very good at it)

  • Fan Art (due to copyright reasons)
